1. GENERAL

Welcome to All Harvest (M) Sdn. Bhd. (“All Harvest”, “we”, “our” or “us”). These Terms & Conditions (“Terms”) govern your use of https://allharvest.farm/en and purchases made through the Website. By using the Website or placing an order, you agree to these Terms. All Harvest may amend these Terms from time to time by publishing an updated version on the Website.

2. USE OF THE WEBSITE

You must use the Website only for lawful purposes. You must not interfere with its operation, gain unauthorized access, introduce malicious code, misuse data, or otherwise violate applicable law. You may not copy or commercially exploit Website content without prior written consent.

3. SITE CONTENT, COPYRIGHT & INTELLECTUAL PROPERTY

5. PRODUCT INFORMATION

All Harvest offers fresh durians, durian-related products and other food products. Images are for illustration and actual products may vary in colour, size, shape, weight, appearance and natural characteristics. Fresh durians are agricultural products and may naturally vary in ripeness, flesh colour, texture, aroma, seed size and taste. Availability may vary according to season, harvest, variety, grade and stock.

6. ORDERS & ACCEPTANCE

All orders are subject to availability and acceptance by All Harvest. We may reject, cancel or limit an order where products are unavailable, incorrectly priced, affected by an obvious listing or system error, or where cancellation is reasonably necessary. An order is accepted only when confirmed by All Harvest.

7. PRICES & PAYMENT

Prices are stated in Malaysian Ringgit (RM) unless otherwise indicated. Prices, promotions and availability may change without notice. Applicable taxes, delivery charges or other fees will be shown at checkout or otherwise communicated before payment. Payment must be successfully completed using an available payment method.

8. DELIVERY & COLLECTION

Orders will be delivered to the address supplied by the customer. The customer is responsible for accurate delivery information. Delivery times are estimates and may be affected by weather, traffic, courier or logistics issues, harvest conditions, regulatory requirements, customs procedures or other circumstances beyond our reasonable control. Third-party delivery arrangements are subject to the applicable rights and remedies under Malaysian law.

9. FRESH PRODUCE, INSPECTION & QUALITY

Customers should inspect orders as soon as reasonably practicable after delivery and promptly report concerns regarding damage, incorrect items or material quality issues, preferably with photographs or video and order details. Customers should follow storage and consumption instructions. Natural variations in sweetness, bitterness, aroma, texture, fibre, seed size and flesh yield are not necessarily defects.

10. RETURNS, REFUNDS & REPLACEMENTS

Because fresh food is perishable, returns may not be accepted after delivery except where required by law or approved by All Harvest. Valid complaints should be made promptly with supporting evidence. Any refund, replacement or other remedy will be assessed case by case and in accordance with applicable law. Nothing in these Terms excludes or restricts any consumer right that cannot lawfully be excluded.

11. CANCELLATION

Cancellation requests must be made before an order is processed, packed or dispatched. Once processing has begun, cancellation may not be possible.

12. RISK & TITLE OF GOODS

Risk of loss or damage passes to the customer upon delivery. Ownership passes upon receipt of full payment, unless otherwise agreed in writing.

13. CUSTOMER REVIEWS & SUBMISSIONS

Where reviews, comments or other submissions are permitted, customers must ensure their content is lawful, accurate and does not infringe third-party rights. All Harvest may remove unlawful, abusive, defamatory, obscene, misleading or inappropriate content. By submitting content, you grant All Harvest a non-exclusive right to use, reproduce and display it for legitimate business purposes, subject to applicable law.

14. MARKETING & COMMUNICATION

Where permitted by law and where applicable consent has been obtained, All Harvest may send information about products, promotions, news and offers. Customers may opt out of marketing communications at any time.

15. THIRD-PARTY LINKS

The Website may contain links to third-party websites or services. All Harvest does not control and is not responsible for their content, availability, security or privacy practices. Access is at the user's own risk.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, All Harvest shall not be liable for indirect, incidental, special or consequential loss arising from use of the Website or purchase of products. Nothing excludes liability that cannot lawfully be excluded. Subject to this, liability is limited to the amount paid for the relevant order or service.

17. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless All Harvest, its directors, employees, agents and service providers from claims, losses, liabilities, costs and expenses arising from your breach of these Terms, unlawful use of the Website or infringement of third-party rights.

18. FORCE MAJEURE

All Harvest shall not be liable for delay or failure caused by circumstances beyond reasonable control, including natural disasters, severe weather, fire, flood, disease outbreaks, agricultural or harvest disruption, war, civil unrest, government action, regulatory restrictions, transport disruption, labour disputes, power failures or system failures. We may suspend, delay, modify or cancel affected orders where appropriate.

19. TERMINATION

These Terms apply while you access or use the Website. All Harvest may suspend or terminate access where a user breaches these Terms or where necessary for security, legal or operational reasons. Provisions intended by their nature to survive termination shall continue.

20. GOVERNING LAW

These Terms are governed by the laws of Malaysia. Disputes shall be subject to the jurisdiction of the Malaysian courts, subject to any mandatory rights or remedies available under applicable law.
